As the prosecution failed to prove a prima facie case, 30-year-old Suhaimi Salleh has been acquitted of a rape charge.
The odd-job labourer, who had been in jail for the last four years in Sungai Buloh, was arrested on 5 November 2003 and charged with the rape of a 15-year-old girl at a bridge near Lebuhraya Kesas in Jalan Medan 23 between 3.30am and 5am on 4 November 2003.
The judge said the victim had only given partial evidence during the examination-in-chief stage and no details on the actual rape was given. The examining doctor had also determined that the victim was still a virgin and there had been no penetration.
