Deputy Public Prosecutor Tun Abd Majid Tun Hamzah examined Assistant Superintendent Zulkarnain Samsudin yesterday in a trial-within-a-trial to determine if accused Corporal Sirul Azhar Umar's statement that led to the discovery of murder victim Altantuya Shaariibuu's jewellery in his apartment can be admitted in court as evidence.
34-year-old Zulkarnain, who led the police search team from the Bukit Aman serious crimes division (D9), said that his team only searched Azhar's bedroom cupboard, looking for his leather jacket that contained Altantuya's watch, ring and a pair of earrings.
He instructed his men to avoid disturbing anything else in the room although he admitted in court that he should have searched the entire room. He denied that he had instructed Azhar to hold the leather jacket and point to the jewellery while photographs of him were taken.
When cross-examined by Azhar's counsel, Kamarul Hisham Kamaruddin, Zulkarnain said he did not show Azhar the police report nor asked him to sign it. It allegedly contained Azhar's statement that led to the jewellery.
Kamarul pointed out to him that Section 112 (5) of the Criminal Procedure Code requires an officer to show the report to the suspect so that he can make corrections before signing it. Zulkarnain flatly replied that he was not aware and said that it was never his intention to record statements from Azhar during the interrogation.
The hearing will continue on 17 September 2007.
